Terms of Service

Plain English Summary

You pay us to build your website or grow your SEO. We do the work professionally and on time. You give us what we need (content, feedback) promptly. We both act in good faith.

1. Acceptance of Terms

By using our website, client portal, or engaging our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. These terms are governed by the laws of the Republic of South Africa.

2. Our Services

LATQO Agencies provides the following services:

  • Custom website design and development
  • E-commerce store design and setup
  • Search engine optimisation (SEO)
  • Client portal access for project management
  • Post-launch support as per your package terms

The specific scope, deliverables, and timeline for your project are confirmed in writing at the time of booking.

3. Payment Terms

Payment upfront

All packages are paid in full at the time of booking via Paystack before project work begins. Your spot is only confirmed once payment is received.

Currency

All prices are listed and charged in South African Rand (ZAR) and include VAT where applicable.

Failed payments

If a payment fails, your booking will not be confirmed and no work will commence until payment is successfully processed.

Invoices

A tax invoice will be issued upon successful payment and accessible through your client portal.

4. Project Timeline & Client Responsibilities

Our delivery timelines depend on timely cooperation from you. To keep your project on track, you agree to:

  • Provide all required content (text, images, logos) within 5 business days of project kick-off
  • Respond to feedback requests and review rounds within 3 business days
  • Designate a single point of contact for your project
  • Provide accurate and complete information about your business and requirements

Delays caused by late content, feedback, or client unresponsiveness will extend the delivery date accordingly. LATQO Agencies will not be held liable for delays resulting from client-side factors.

5. Revisions & Scope

Each package includes a defined number of revision rounds as stated in the package description. Revisions are defined as minor adjustments to the agreed design — not scope changes. Additional revisions or scope additions beyond the agreed package will be quoted and billed separately before work begins.

6. Intellectual Property

Your content

You retain full ownership of all content you provide to us (text, images, logos, brand assets). You confirm you have the right to use this content.

Your website

Upon full payment, you own the final website and all custom code we write for you. We transfer full ownership to you at project completion.

Our tools & processes

We retain ownership of our internal tools, templates, frameworks, and methodologies. These are not transferred as part of any project.

Third-party assets

Stock images, fonts, or plugins used in your project are subject to their own licences. We will inform you of any ongoing licence costs.

7. Client Portal

Your client portal account is personal to you. You are responsible for:

  • Keeping your login credentials secure and confidential
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorised access

We reserve the right to suspend accounts that violate these terms or are used for any unlawful purpose.

8. Limitation of Liability

LATQO Agencies will not be liable for any indirect, incidental, or consequential damages arising from use of our services, including but not limited to loss of revenue, loss of data, or business interruption. Our total liability in any matter is limited to the amount paid for the specific service in question.

We do not guarantee specific rankings, traffic numbers, or business outcomes from our SEO or web design services, as these depend on many factors outside our control.

9. Confidentiality

Both parties agree to keep confidential any sensitive business information shared during the course of the project. We will never share your project details, business information, or client portal data with third parties except as described in our Privacy Policy.

10. Portfolio Rights

Unless you request otherwise in writing before project commencement, we reserve the right to display your completed website in our portfolio and use it as an example of our work in marketing materials. We will never share confidential business information — only the design and public-facing website.

11. Termination

Either party may terminate the project agreement with 5 business days' written notice. In the event of termination, payment for work already completed will be retained. Please refer to our Refund Policy for details on what is refundable.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.

13. Changes to These Terms

We may update these terms from time to time. Continued use of our services after any changes constitutes acceptance of the updated terms. We will notify active clients of material changes by email.
